Top Dog Raffle – Monthly Prize Draw Competition Rules
These rules (“Rules”) govern the monthly prize draw competition (“Prize Draw”) organized by Top Dog Raffle, trading as Grenada Consulting Inc. (“Organizer,” “we,” or “us”). By purchasing a raffle ticket and participating in the Prize Draw, participants (“Participants” or “you”) agree to be bound by these Rules. Please read them carefully.
DEFINITIONS
- “Organizer”: Refers to Grenada Consulting Inc. (GCI), a company registered in Grenada, which operates under the trading name “Top Dog Raffle.” The Organizer is responsible for organizing and managing the Prize Draw, ensuring compliance with applicable laws, and administering all associated processes, including ticket sales, winner selection, and prize distribution.
- “Prize Draw”: The monthly competition event organized by the Organizer, wherein Participants who purchase raffle tickets are entered for a chance to win prizes. The Prize Draw occurs on the scheduled date, as stipulated in these Rules, and adheres to the regulations outlined in the relevant gaming laws of Grenada.
- “Participant” or “Participants”: Any individual who purchases a raffle ticket and thereby enters the Prize Draw. Participants must meet the eligibility criteria set forth in these Rules and comply with all legal requirements established by Grenada’s legislation governing gaming and lotteries.
- “Raffle Ticket”: A digital or physical ticket purchased by a Participant to gain entry into the Prize Draw. Each Raffle Ticket is unique and non-transferable, serving as proof of participation in the Prize Draw for the corresponding period.
- “Prize” or “Prizes”: Refers to the items or rewards offered by the Organizer that Participants have the chance to win during the Prize Draw. The specifics of the Prize, including type and value, may vary for each draw period and will be announced in advance by the Organizer.
- “Draw Date”: The date on which the Prize Draw is conducted. It is scheduled for noon Grenada Time on the Sunday following the last Friday of each month. The Organizer reserves the right to adjust the time of the draw in accordance with these Rules.
- “Winner”: The individual selected through the Organizer’s certified randomization process during the Prize Draw. The Winner is eligible to receive the Prize, provided they comply with the conditions and verification procedures outlined in these Rules.
- “Draw Period”: The date on which the Prize Draw is conducted. It is scheduled for 8 pm Grenada Time on the Monday following the last Friday of each month. The Organizer reserves the right to adjust the time of the draw in accordance with these Rules.
- “Immediate Family Member”: Includes the spouse, parents, siblings, and children of an employee, affiliate, director, or officer of Top Dog Raffle. Immediate Family Members are ineligible to participate in the Prize Draw to prevent conflicts of interest and ensure fairness.
- “Verification”: The process by which the Organizer confirms the identity, eligibility, and authenticity of the Participant and their Raffle Ticket. Verification may include requesting additional documents or information to validate the winner’s eligibility for the Prize.
- “Gaming, Betting, and Lotteries Act” (Cap 120): This act governs gaming, betting, and lottery activities in Grenada. It sets the legal framework for the conduct of the Prize Draw, including rules on eligibility (e.g., age requirements under Section 41), transparency, and procedures for conducting prize draws (e.g., random selection processes under Section 21).
- “Consumer Protection Act” (No. 2 of 2018): Outlines regulations ensuring fair business practices in Grenada. It governs the conduct of lotteries and prize draws, protecting consumer rights and safety. This Act also provides guidelines for notifications, amendments of rules, and the finality of decisions related to consumer contests.
- “Data Protection Act” (No. 1 of 2023) (GDPA): Establishes guidelines for the collection, processing, and storage of personal data in Grenada. It ensures Participants’ personal information is protected and sets standards for its lawful and transparent management, including conditions under which personal data can be disclosed and the rights of individuals to access and update their data.
- “Civil Liability Act” (Cap 72B): This act outlines the rules for liability in commercial and gaming activities, ensuring fair practices and setting limitations on liability. It governs the enforcement of these Rules and provides legal standards for modifications or cancellations of contracts.
- “Electronic Communications Act”: Governs the use of electronic communication for notifications and other interactions between the Organizer and Participants, ensuring compliance with digital and electronic communication standards in Grenada.
- “Fraud Prevention Act”: Regulates measures to prevent fraudulent activities in commercial and gaming events, ensuring fairness and transparency. This Act provides guidelines for verifying participant information and the Organizer’s right to disqualify participants involved in fraudulent behavior.
- “Gaming Regulations Act”: Provides specific procedures related to forfeiture and prize eligibility, ensuring the integrity of gaming events by outlining guidelines for these processes.
- “Force Majeure”: An event or circumstance beyond the reasonable control of the Organizer, which may prevent or hinder the fulfillment of obligations under these Rules. This may include natural disasters, technical failures, regulatory changes, or other unforeseen events that disrupt the operation of the Prize Draw.
Eligibility and Participation
1.1. The Prize Draw is open exclusively to individuals who are at least 18 years of age or have reached the age of majority as defined by their jurisdiction, whichever is higher. Participation must comply with the legal framework established under the Gaming, Betting, and Lotteries Act of Grenada, Section 41.
1.2. By purchasing a raffle ticket and participating in the Prize Draw, you affirm and warrant that you have the legal capacity and authority to participate, as per the laws of Grenada or your country of residence if accessing from outside Grenada. Non-compliance with any legal requirements or restrictions, including those stipulated in the Civil Liability Act regarding contract enforcement, may result in disqualification from the Prize Draw.
1.3. Participation in the Prize Draw is not open to employees, affiliates, directors, officers, or immediate family members of Top Dog Raffle. This exclusion ensures compliance with the Anti-Fraud and Fair Gaming Regulations of Grenada, Section 6.
1.4. The Organizer reserves the right to verify the eligibility of any Participant at any stage of the Prize Draw. Participants found to have provided false, misleading, or inaccurate information will be immediately disqualified per the Fraud Prevention Act, Section 8.
1.5. Residents of jurisdictions where participation in such prize draws or gaming activities is restricted or prohibited by law are not eligible to enter.
Raffle Ticket Purchase and Validity
2.1. Raffle tickets for each Prize Draw are available for purchase until 11:59 PM Grenada Time on the last Friday of each month. The Organizer strictly adheres to this cut-off time to ensure fairness and transparency in the administration of the Prize Draw.
2.2. The Prize Draw will be conducted at or around 8 pm Grenada Time on the following Monday. The timing of the draw may vary slightly due to operational requirements, but every effort will be made to conduct it as close to the scheduled time as possible to maintain consistency and fairness.
2.3. Any raffle tickets purchased after the official cut-off time will not be eligible for the current month’s Prize Draw. Instead, such tickets will be automatically entered into the next scheduled Prize Draw, ensuring that late entries still have an opportunity to participate.
2.4. All raffle tickets are non-refundable and non-transferable. Once a purchase is made, it is considered final, and no exchanges, cancellations, or refunds will be permitted.
2.5. The Organizer reserves the right to verify the authenticity of each raffle ticket and may reject any entries that appear fraudulent, suspicious, or in violation of these Rules. The Organizer also reserves the discretion to disqualify Participants who engage in any behavior that compromises the integrity of the Prize Draw.
2.6. It is the Participant’s responsibility to retain proof of purchase and ensure that they meet all eligibility and entry requirements as stipulated in these Rules. Failure to comply may result in the disqualification of the Participant’s ticket(s) without compensation or recourse.
Entry Information and Verification
3.1. Participants are required to provide accurate and complete information when purchasing raffle tickets. This includes, but is not limited to, their first name, last name, and phone number. To facilitate communication and ensure prompt notification in the event of winning, Participants are also encouraged to provide additional contact details, such as a valid email address or Instagram handle. By providing this information, Participants confirm that all details submitted are true and accurate.
3.2. The Organizer reserves the right to verify the identity and eligibility of Participants at any point—before, during, or after the Prize Draw. Verification may include, but is not limited to, requesting additional identification documents or proof of eligibility. Winners will be required to present a valid form of identification (such as a passport, driver’s license, or national ID) when receiving their prize. Failure to provide accurate information or to comply with verification requests may result in immediate disqualification from the Prize Draw, and any tickets associated with the disqualified Participant may be rendered void.
3.3. If discrepancies or irregularities are found during the verification process, the Organizer may take appropriate action, including disqualification of the Participant and forfeiture of any prize they may have been eligible for. Such actions are taken to ensure the integrity and fairness of the Prize Draw.
3.4. The Organizer also reserves the right to conduct periodic audits of participant information and entries to detect fraudulent activities. If any fraudulent behavior is discovered, the Organizer may disqualify the offending Participant and take further legal action as deemed necessary.
3.5. It is the responsibility of the Participants to ensure that their contact information remains current and accessible throughout the duration of the Prize Draw. The Organizer shall not be held liable for any failure to contact a Participant due to outdated or inaccurate contact information.
Prize Draw and Winner Selection
4.1. Each Prize Draw will result in the selection of one winner per prize, determined through a randomized and certified selection process in compliance with the Gaming, Betting, and Lotteries Act, Cap 120, Section 21. This ensures fairness, transparency, and impartiality. The randomization process maintains the integrity of the draw and protects the interests of all Participants.
4.2. The selected winner will be officially notified within 24 hours of the conclusion of the Prize Draw. The Organizer will make initial contact using the phone number provided at the time of ticket purchase, as required under the Consumer Protection Act of Grenada, Section 15, which mandates prompt notification for consumers participating in lotteries or prize draws.
4.3. If the Organizer is unable to reach the winner within 24 hours using the primary contact method, alternative methods such as the email address or Instagram handle provided by the Participant will be used. This approach is consistent with the Electronic Communications Act of Grenada, Section 6, governing the use of digital communication for notifications.
4.4. Should the winner fail to respond or acknowledge the Organizer’s notification within 72 hours of the Prize Draw, they will automatically forfeit their right to the prize, as stipulated in the Gaming Regulations Act, Section 18, which permits forfeiture in cases of non-response. In such circumstances, a secondary random draw will be conducted to select a new winner, excluding the original winner from further consideration.
4.5. The decision of the Organizer regarding the selection of the winner and any issues arising from the Prize Draw is final and binding, authorized under the Civil Liability Act, which governs the enforcement of decisions and contract provisions.
4.6. The Organizer reserves the right to publicly announce the winner’s first name, initial of their last name, image, address, and social media handle (if applicable) for promotional purposes, in accordance with the Data Protection Act of Grenada, Section 9, which permits the use of personal data with the Participant’s consent. By participating in the Prize Draw, Participants consent to such publicity unless otherwise prohibited by law.
4.7. If it is discovered that the winner has violated any of these Rules, provided false information, or engaged in fraudulent activity, the Organizer reserves the right to disqualify the winner and reclaim the prize, consistent with the Fraud Prevention Act of Grenada, Section 12, allowing organizers to take measures against fraudulent behavior. A new winner will be selected following the procedures outlined above.
4.8. All Participants acknowledge that by entering the Prize Draw, they waive any legal or equitable claim arising from the conduct of the draw, the method of winner selection, or any related aspect, provided the Organizer has acted in good faith and in accordance with these Rules as outlined in the Gaming, Betting, and Lotteries Act, Cap 120, Section 20.
Prize Collection and Forfeiture
5.1. The winner is required to collect their prize in person within the Parish of St George, Grenada, at a location and time agreed upon by both the Organizer and the winner. The specific details will be communicated directly to the winner to ensure a smooth collection process.
5.2. The Organizer will make arrangements for the prize handover within 7 days of establishing contact with the winner. If the winner fails to collect the prize within this timeframe, the prize will be considered forfeited. The Organizer reserves the right to conduct an additional draw to select an alternative winner. This ensures the continued fairness and integrity of the Prize Draw.
5.3. It is the sole responsibility of the winner to arrange and cover their own transportation and any other associated costs for collecting the prize. The Organizer will not be liable for any expenses incurred by the winner in connection with the prize collection.
5.4. In the event that the winner is unable to collect the prize within the stipulated timeframe due to unforeseen circumstances, they must inform the Organizer as soon as possible. The Organizer, at its discretion, may consider extending the collection period or making alternative arrangements, provided the request is reasonable.
5.5. All decisions made by the Organizer regarding the forfeiture of prizes and the selection of an alternative winner are final and binding. The Organizer is not obligated to entertain any appeals or correspondence regarding such matters.
Publicity and Promotional Requirements
6.1. By participating in the Prize Draw, Participants grant the Organizer permission to use their name, image, address, and social media handles for promotional and marketing purposes. This consent includes, but is not limited to, use in social media posts, digital campaigns, and advertisements, without any additional compensation or remuneration, except where such use is prohibited by applicable law.
6.2. Winners agree to participate in photo and video shoots organized by the Organizer during prize collection. The Organizer may use these images and videos across various promotional platforms, including the official website, social media channels, and other marketing materials.
6.3. Should a winner decline to participate in any of the promotional activities or refuse to have their details publicized, they will automatically forfeit the prize. In such an instance, the Organizer reserves the right to select a new winner by conducting another random draw, excluding the original winner.
6.4. Winners who choose to opt out of promotional activities after being selected may not claim or transfer their prize at a later date. The forfeiture will be considered final, and the Organizer will proceed to select an alternate winner to maintain the integrity of the Prize Draw.
6.5. Participants acknowledge that their participation in promotional activities may include their name , address and image being displayed on the Organizer’s platforms. The Organizer will take all necessary measures to ensure that promotional activities respect privacy and adhere to relevant marketing standards.
Data Protection and Privacy
7.1. The Organizer is committed to protecting the privacy of Participants and will collect, process, and store personal data in strict compliance with the Data Protection Act, No. 1 of 2023 (GDPA), Section 3. This section establishes that all data processing must be lawful, fair, and transparent, ensuring that personal data is managed solely for the administration of the Prize Draw.
7.2. Personal information collected from Participants, including names, contact details, and any other relevant information, will be used solely for administering the Prize Draw, contacting winners, and conducting promotional activities as outlined in these Rules. Personal data will not be shared with third parties without the Participant’s explicit consent, except where necessary for prize distribution, promotional activities, or as required by law, consistent with GDPA, Section 9, which governs the conditions under which personal data may be disclosed.
7.3. Participants have the right to access, update, correct, or request the deletion of their personal data. Requests must be made in writing to the Organizer at [email protected] .The Organizer will respond to such requests in accordance with the timelines stipulated by GDPA, Section 8, ensuring Participants’ rights are respected and upheld.
7.4. By participating in the Prize Draw, Participants acknowledge and consent to the processing of their personal data as described in these Rules and agree to the Organizer’s Privacy Policy, which is available on the Organizer’s website. This processing aligns with GDPA, Section 7, which requires that participants are informed about the purpose and methods of data processing.
Limitation of Liability
8.1. The Organizer accepts no liability for entries that are lost, delayed, misdirected, incomplete, or corrupted due to technical issues, network failures, or any circumstances beyond the Organizer’s reasonable control. This limitation is in accordance with the Civil Liability Act, Cap 72B, which governs liability in commercial and gaming activities in Grenada.
8.2. To the fullest extent permitted by law, the Organizer and its affiliates shall not be liable for any direct, indirect, incidental, or consequential loss, damage, or injury arising from participation in the Prize Draw or acceptance of the prize. Participants acknowledge that they participate at their own risk, and the Organizer’s liability is limited to the administration of the Prize Draw as outlined in these Rules.
8.3. The Organizer reserves the right to cancel, modify, or suspend the Prize Draw if any unforeseen event occurs that affects the fairness, integrity, or administration of the competition, including but not limited to force majeure, fraud, technical failures, or legal or regulatory changes. Such actions are taken under the authority granted by the Gaming, Betting, and Lotteries Act, Cap 120, Section 18, which allows for modifications or suspension under these circumstances.
8.4. In the event of cancellation, modification, or suspension of the Prize Draw, the Organizer will provide reasonable notice to Participants. The Organizer shall not be held liable for any losses or damages resulting from such actions, in accordance with the Civil Liability Act, Cap 72B.
General Terms
9.1. The Organizer reserves the right to amend these Rules at its sole discretion. Any amendments will become effective immediately upon being posted on the Organizer’s website. It is the responsibility of Participants to review these Rules periodically to stay informed of any changes. Continued participation in the Prize Draw after such amendments constitutes acceptance of the revised Rules. This clause is consistent with the Consumer Protection Act, No. 2 of 2018, Section 17, which permits organizers to set terms and modify them as necessary.
9.2. All decisions made by the Organizer concerning the Prize Draw, including but not limited to eligibility, ticket validity, the drawing process, and winner selection, are final and binding. No correspondence, appeals, or disputes will be entertained, as permitted under the Consumer Protection Act, Section 11, which governs the finality of decisions in consumer-related contests.
9.3. By participating in the Prize Draw, Participants agree to comply with these Rules and acknowledge that they are legally bound by them. Failure to comply with these Rules may result in disqualification and forfeiture of any prizes awarded. This aligns with the provisions of the Consumer Protection Act ensuring compliance and protection of consumer interests.
Governing Law and Jurisdiction
10.1. These Rules are governed by and construed in accordance with the laws of Grenada, including the relevant provisions of the Civil Liability Act, the Gaming, Betting, and Lotteries Act, and the Consumer Protection Act.
10.2. Any disputes, claims, or controversies arising out of or relating to these Rules, the Prize Draw, or any rights or obligations of the Organizer and Participants shall be resolved exclusively by the courts of Grenada. By participating in the Prize Draw, Participants agree to submit to the jurisdiction of the courts of Grenada and waive any objections to venue based on the doctrine of forum non conveniens.
10.3. If any provision of these Rules is found to be unlawful, void, or unenforceable under the laws of Grenada, such provision shall be severed from these Rules and shall not affect the validity and enforceability of the remaining provisions.
